III – THE SERVICE PROVIDED:

10) www.milacostaroupas.com.br is limited to conducting import transactions exclusively between natural persons and does not intermediate imports between natural persons and legal entities.

12) The (domain) does not supply any products advertised on the website. The (domain) provides a service that connects the “BUYER” with products and merchandise from the supplier, which may be domestic and/or imported.

13) The “INTERMEDIARY” cannot be held responsible for the right of withdrawal regarding products purchased on the website www.milacostaroupas.com.br, as it only intermediates between the interested parties.

IV- THE BUYER’S CAPACITY

14) The services provided by the “INTERMEDIARY” are available only to natural persons who have the legal capacity to enter into contracts.

15) The “INTERMEDIARY” does not conduct transactions with “BUYERS” who lack civil capacity (natural persons), without prejudice to the application of the legal penalties provided for in the Brazilian Civil Code, notably Articles 166, I; 171, I; and 180.

V- AMENDMENTS TO THE GENERAL TERMS AND CONDITIONS

16) The “INTERMEDIARY” may, at any time, amend these General Terms and Conditions to enhance and improve the services provided. The new General Terms and Conditions will take effect 10 (ten) days after their publication on www.milacostaroupas.com.br and the Sites. Within 5 (five) days of the publication of the new version, the “BUYER” must communicate by email if they do not agree with the amended terms. In such a case, the contractual relationship will cease to exist. If no communication is received within the specified period, it will be understood that the User has accepted the new General Terms and Conditions of Use and the contract will continue to bind the parties. The amendments will not apply to negotiations already underway before their publication, in which case the previous wording will remain in effect.

VI- ADVERTISED PRODUCTS AND LIMITATION OF LIABILITY

18) The “BUYER” expressly understands and agrees that, to the extent permitted by applicable law, the “INTERMEDIARY” shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including, without limitation, damages for lost profits, goodwill, use, data, or other intangible losses resulting from the use of or inability to use the Service.

19) To the extent permitted by applicable law, under no circumstances shall the “INTERMEDIARY” be liable for lost profits or any special, incidental, or consequential damages arising out of or related to our website, our Services, or these Terms of Service, regardless of the cause, including negligence.

20) The “INTERMEDIARY” does not guarantee that the Services will be uninterrupted, timely, secure, or error-free, nor does it guarantee that the results that may be obtained from using the Services will be accurate or reliable.

21) The “INTERMEDIARY” does not guarantee the quality of the products, services, information, or other materials purchased or obtained by the “BUYER.” 22) The “INTERMEDIARY” does not issue refunds.

PAYMENT OF FEES

23) The “BUYER” is responsible for all applicable taxes arising from or resulting from the purchase of products. To the extent that these taxes are charged, tax rates applicable to the billing address you provided will be calculated. These amounts are in addition to the fees for products and services and will be charged using your Authorized Payment Method.
